BFMR Refer-A-Friend Program Terms and Conditions

The BFMR “Refer-A-Friend” program terms and conditions (the “Terms”) apply to the BFMR Refer-A-Friend program. "BFMR," the “Company,” "we," "us," or "our" means BuyForMeRetail LLC or its subsidiaries, including BFMR-affiliated company(ies) providing services to you, as applicable. BFMR offers the Terms to our members who are interested in qualifying for bonuses by referring new members to sign up and use www.bfmr.com. These Terms govern the participation by existing BMFR members with an account in good standing who refer (the “Referrers”) and the persons who are referred by the Referrers (the “Referees”). Any capitalized term not defined herein shall have the meaning ascribed to it by the applicable incorporated terms.

1. General

The BFMR “Refer-A-Friend” program is only open to members who reside and are located in the 50 United States, District of Columbia, or Canada.

These Terms are in addition to any agreements between you and BFMR, including our Terms and Conditions and Privacy Policy, which are hereby incorporated by reference, and shall apply to your participation in the BFMR Refer-A-Friend program.

2. Qualified Referrals

A “Qualified Referral” is a Referee who must:

a. Be a natural person (i.e., no businesses, legal entities or pets) residing in and located in the 50 United States, District of Columbia, or Canada who is able to receive ACH payments;

b. Be a new member to www.bfmr.com;

c. Sign up to become a member using a Referrer’s custom referral link or other method supplied that allows for proper tracking of referrals;

d. Meet the program requirement thresholds on the date of account creation (together, “ Program Qualifications”) or otherwise;

e. Consent to and comply with the Terms and Conditions and Privacy Policy;

f. Be the individual who executes the Program Qualifications; and

g. Be at least 18 years of age.

3. BFMR Refer-A-Friend Program Bonuses

Referrers and/or Referees may qualify for Referral Bonus(es), which may change from time to time.

4. Payment Conditions; Review Period

Referral Bonuses will only be payable after (i) successful completion of all identity verification and compliance screening procedures required by BFMR, (ii) satisfaction of Program Qualifications, and (iii) completion of any internal fraud review. BFMR in its sole discretion may delay payment pending internal investigation if fraud or lack of qualifications are suspected. No bonus is earned until actually paid.

5. Representations

By participating in the BFMR Refer-A-Friend program, as a Referrer or Referee, you represent and warrant that you will comply with all applicable BFMR policies and terms, and any and all applicable laws, rules and regulations in your participation in the BFMR Refer-A-Friend program.

You represent and warrant that you are not (i) located in, organized in, or ordinarily resident in any sanctioned jurisdiction, (ii) listed on any OFAC, BIS, EU, UK, or Canadian sanctions list, or (iii) acting on behalf of any restricted party.

You are solely responsible for any statements, representations, or communications you make in connection with the BFMR Refer-A-Friend Program. You agree that any promotion or referral activity you conduct will comply with all applicable laws, rules, and regulations, including without limitation consumer protection, anti-spam, advertising, and disclosure laws. You may not make any representation about BFMR or the Program that is false, misleading, or inconsistent with these Terms. Nothing in the Program creates any agency, partnership, employment, or representative relationship between you and BFMR.

6. Restrictions

The following is a non-exhaustive list of activities that are not permitted and that will disqualify Referrers and Referees from earning Referral Bonuses through the BFMR Refer-A-Friend program:

(i) self-referral;

(ii) making purchases on behalf of another or under a BFMR account that is not yours;

(iii) creating fake accounts, profiles, links, or messages, or using stolen, fabricated, or misappropriated credentials or identity information;

(iv) misleading or attempting to mislead anyone in connection with the BFMR Refer-A-Friend program, including, but not limited to, misrepresenting your relationship with us or posing as our representative in an official capacity;

(v) accessing or interacting with the BFMR Refer-A-Friend Program through automated means, including bots, scripts, crawlers, or similar technologies, or through the use of VPNs, proxy networks, anonymization services, or other methods intended to conceal or manipulate device, network, or geographic information;

(vi) participating in coordinated referral schemes, referral rings, or other structured activity designed to artificially satisfy Program Qualifications or manipulate the referral process; and

(vii) taking any action or making any content that is disparaging or defamatory to us.

Multiple accounts created with one or more of the following: the same or similar name, physical address, email address, IP address, device identifier, bank account, payment method, or any other common or shared identifier, may be deemed to be fraudulent or abusive referrals and disqualified or terminated at our sole discretion.

7. Clawback; Reservation of Rights

If BFMR determines, in its sole discretion, that any Referral Bonus was earned in violation of these Terms, through manipulation, fraud, structured activity, or other abusive conduct, BFMR may (i) reverse or claw back such amounts, (ii) offset such amounts against any other sums owed, and/or (iii) pursue recovery through legal means.

We reserve the right to withhold, deny or cancel any Referral Bonus and/or terminate your account if BFMR, in its sole discretion, deems any Referral Bonus as fraudulent, abusive, unethical, suspicious or otherwise inconsistent with these Terms, the Terms and Conditions and Privacy Policy, or any other applicable law or regulation. Our decisions are final.

8. Taxes

You are solely responsible for reporting and paying any federal, state, local, or other taxes arising from your participation in the Program. BFMR does not provide tax advice. You acknowledge that BFMR makes no representations regarding the tax treatment of any Referral Bonus. You are responsible for consulting your own tax advisor regarding your tax obligations.

9. Limitation of Liability; Disputes

To the maximum extent permitted by applicable law, BFMR shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or relating to the Refer-A-Friend Program. In no event shall BFMR’s total aggregate liability arising out of or relating to the Program exceed the total amount of Referral Bonuses actually paid to you by BFMR during the three (3) month period immediately preceding the event giving rise to the claim. 

Any dispute arising under the Referral Program shall be governed by and subject to the dispute resolution provisions of the BFMR Terms and Conditions.

10. Termination and Interpretation

We reserve the right to suspend or terminate the BFMR Refer-A-Friend program or to change these Terms at any time and for any reason in our sole discretion, with or without notice to you. All interpretations of these Terms will be at our sole discretion and our decisions will be final.
